Both the Presidential Decree 30th September 1963 n. 1409 and the current Code for Cultural Assets (legislative decree 22nd January 2004 n. 42) made a distinction between private and public archives and between their respective monitoring, the former were assigned to the Superintendence offices, and the latter to the State Archives. The Code introduced the distinction between for profit private institutions (in which commercial companies are included) and non-profit private institutions.
